TERMS AND CONDITIONS

Joel’s Tractors and Auction, LLC recommends that Bidders preview equipment prior to bidding or to contact us prior to the Auction to speak with a representative.  We put forth every effort to describe and represent equipment accurately and to the best of our ability. Please call ahead as soon as possible as the days are remarkably busy right before the sale and there may not be enough time to answer all questions received.  Any errors made in picturing or describing items does not negate the Buyer’s responsibility to pay their invoices.  It is the Buyer’s responsibility to make sure each item meets his/her needs before placing any bid.

Preview Dates and Times EVERY WEEKDAY!! Monday- Friday from 8-5 and Saturday, April 10th from 9:00 AM until 3:00 PM.

PAYMENT TERMS:

Payment must be made within 3 business days of the auction, which is by the end of the day Wednesday, April 21st.  Note:  Dead beat bidders and non-payers will not be tolerated.  Joel's Tractors & Auction, LLC and UseLevel reserves the right to deny bidding privileges for current and future auctions and your bidding privileges can be revoked.

To better serve our customers, all bidders must provide their name, address, daytime phone number and e-mail address at which they can be contacted.  Invoices for on-line buyer’s will be e-mailed after the sale is complete to the e-mail used at registration. The invoice will be an attachment in a PDF format. The email will be coming from everitttractors@gmail.com.  Please check your spam box if you do not find it.  If you do not receive an invoice within 48 hours after the sale and you believe you won the bid on one or more items please give us a call at 563-933-4188.

To enable bidders to participate in our auctions using the internet through the UseLevel platform without the travel expense and lost time, buyers will pay an additional Buyer’s Premium fee equal to 5% of the purchase price, up to $20,000 purchase price ($1,000 cap).  There is not a fee to register, watch, listen or to bid.  These fees apply only to internet buyers.  A 6% state sales tax and 1% local option sales tax (total of 7%) applies on all lawn and garden items, construction equipment and non-farm applicable items.  Farmers and dealers must sign an exemption on all farm exempt items.

Payment Options:  Bank Wire ($10 fee) (Wiring information will be provided in the e-mail along with the invoice), Cash (if paying in person), Cashier’s Check (recommended on out of state purchases if not using a bank wire), Regular check for local or return business customers or known equipment buyers (must be paid in person or mailed immediately upon receiving the invoice). All checks need to be payable to Joel’s Tractors & Auction, LLC.   A letter of bank credit for new first time unknown buyers is highly recommended (email them to laura@everitttractors.com). All sales are final.  IMPORTANT NOTE:   Credit Cards are only used for a verification tool to register for online bidding and no fee will be charged to register (registration fee is returned once your identity is verified).   If payment has not been received for items purchased in a prompt manner, Joel’s Tractors and Auction, LLC reserves the right to charge the credit card used by the buyer for registration through a Stripe platform. A 3% processing fee will be added onto the total buyer’s invoice when charged on the credit card. 

Trucking:  Buyer is Responsible for all trucking...We do have trucking available anywhere in the USA feel free to call us after the auction and we can get you a trucking quote.  When asking about trucking please have the following information available:  Invoice Number - Lot Number – Equipment Make and Model – - Shipping Address and a Telephone Number. Also, please understand that we will be terribly busy after the sale and information on trucking will be provided when we have time to assist you.

Checkout/Pickup Times any time Monday thru Friday from 8 A.M.-4:30 P.M and Saturday April 24th from 9 A.M. – 3 P.M. This is the only Saturday pick up date. We are giving you 30 days to pick up your items. All invoices need to be paid before pick-up and a paid receipt will need to be shown to staff for the item to be removed. We have loaders and loading docks to load your items FREE OF CHARGE...items left after 30 days will have a storage fee apply. Items left longer than 60 days will be considered abandoned, and your items will be disposed of.

SPECIAL TERMS

All items sold "AS IS" and ALL SALES ARE FINAL...Items are open through public inspection. It is the buyer’s responsibility to determine condition, year, and genuineness, value, or any other factor. Joel's Tractors and Auction and its Auctioneers may attempt to describe the merchandise, but in no event may Joel's Tractors and Auction be held responsible for misrepresentations of any kind. Bidders hold sole responsibility of age and condition.

Joel's Tractors and Auction are not responsible for any errors or omissions in the description. Buyer agrees that everything is sold as is with no warranty.

Joel's Tractors and Auction are supplying a bidding platform as a service to an offsite bidder. Bidder acknowledges and understands that this service may not function properly the day of the auction. Under no circumstances shall the bidder have any kind of claim against Joel's Tractors and Auction if the internet happens to fail for any reason.

If you are worried about the possibility of an internet failure you are encouraged to attend the auction in person or to call the office and leave an absentee bid before the day of the sale.

Joel's Tractors and Auction reserves the right to pull a catalog item at any time and for any reason.  Purchases become the responsibility of and shall be and remain at the risk of the purchaser immediately upon acceptance of his bid.  It shall be the responsibility of the purchaser to insure his purchase immediately. 

Joel’s Tractors & Auction, LLC reserves the right to refusal (approval to bid) anyone deemed to be a potential detriment to the conduct of the auction.  All announcements made day of auction take precedence over all printed or verbal statements made prior to auction day.  If you agree to the terms and conditions above, you may register for this auction.  Registering for this Auction means that you agree to both the UseLevel and Joel’s Tractors and Auction, LLC terms and conditions for this auction.
